These Terms and Conditions govern the rental of Cortijo Bujio (Montefrío, Granada) by Montefrio Ventures, S.L. They apply in addition to — and do not limit — your mandatory statutory rights as a consumer under Spanish and EU law.
Montefrio Ventures, S.L., España, is the owner of the holiday let accommodation ("the Property") and the Contract entered into which is the subject of these terms and conditions is made between Montefrio Ventures and the hirer ("the Hirer").
Whilst Montefrio Ventures has taken great care to ensure the accuracy, at the time of going to press, of the information contained in the brochure, website or other information supplied to the Hirer relating to any services supplied, no warranty is given as to their accuracy. Montefrio Ventures does not accept responsibility for any loss or damage resulting from information given or statement made whether orally or in writing.
Bookings will be confirmed on receipt by Montefrio Ventures of a deposit of 25% of the total rent payable. The balance of the rental plus any security deposit is payable to Montefrio Ventures not less than four weeks (30 days) prior to the date of commencement of the hiring. If the balance of the total rental payable together with any security deposit is not paid prior to this date Montefrio Ventures reserves the right to cancel the booking and retain the deposit paid.
If the reservation is being made within eight weeks (60 days) of the commencement of the stay then the total rent together with any security deposit is payable when the reservation is made and accepted.
Payments should be made to Montefrio Ventures. Payments should be made by credit card, electronic bank transfer or PayPal. Bank details are available on request. Bookings must be accompanied by a completed and accurate booking form.
Any cancellation must be sent to Montefrio Ventures in writing by the Hirer named on the booking form. The effective date of cancellation will be the date that the written instructions are received by Montefrio Ventures. The cancellation fee will be 25% before 60 days of the commencement of the Let. If the cancellation is less than 60 days the fee would be the full cost of the Let. In the event that Montefrio Ventures are able to re-let the property then the balance at the same cost, the fee and security deposit will be reimbursed to the Hirer, less the administration costs of 75 Euros. The Provider reserves the right to make a 75.00 Euro per week administration charge for any property or date alteration after the booking has been confirmed. No booking alterations can be made within two months of the start date of the holiday.
Montefrio Ventures reserve the right to request a security deposit which will be refunded within 7 days following the completion of the hiring, less any charges incurred as a result of the failure by the Hirer to meet his responsibilities as set out in conditions 10 & 11.
The Property is let exclusively as short-term holiday/tourist accommodation (vivienda turística de alojamiento rural). Such lettings are excluded from residential tenancy law under Article 5 of the Spanish Urban Leases Act (Ley 29/1994, LAU) and are governed by the Andalusian tourism regulations; they do not create a residential landlord-and-tenant relationship.
Value Added Tax is included in the rental charge where applicable.
The Hirer is responsible for the Property during the period of rental and is expected to take reasonable care of it. All equipment and utensils must be left clean and tidy at the end of the hire period. The Hirer is expected to leave the property in the same state of cleanliness, general repair and the order in which it was found. An additional charge of 150 Euros may be made if extra cleaning is required.
Montefrio Ventures will check the condition and contents of the Property and will notify the Hirer within seven days of any additional cleaning costs or charges for damage and breakages for which the Hirer is liable. Payment shall be made by the Hirer immediately on receipt of the invoice in respect of the above charges. Where a security deposit has been taken, the charges will be deducted from the deposit and the balance refunded to the Hirer by Montefrio Ventures within seven days. Security deposits will be held in full, pending the outcome of any legal action and refunded less any costs, if the Hirer is found liable.
Unless otherwise agreed in writing between Montefrio Ventures and the Hirer, no more than the maximum number of persons as stated on the web site may occupy the Property. Admittance may be refused if this condition is not observed. An additional charge of 50 Euros per person per night will be added to the Hirer's account if these terms are not complied with.
Montefrio Ventures reserves the right to refuse or revoke bookings from parties which may in their opinion be unsuitable for the property concerned. In such cases all payments made will be refundable in full and the contract will be discharged.
The right is reserved to terminate the booking with immediate effect if the Hirer fails to observe the Rules imposed from time to time by Montefrio Ventures and in the event of termination under the provisions of this clause the Hirer will not be entitled to any refund of the hiring fee paid. The Rules are set out in the Schedule hereto and Montefrio Ventures reserves the right to alter, amend or add to the Rules and conditions at any time.
All complaints must be referred to Montefrio Ventures S.L. who will promptly and fully investigate the matter and ensure that corrective action is taken if the complaint is found to be substantiated. Montefrio Ventures S.L. will not entertain or consider any complaints or claims for compensation unless the complaint or problem has been raised by the Hirer in the course of the hiring or in circumstances in which it is possible for Montefrio Ventures S.L. to investigate the complaint effectively and take the necessary corrective action.
Whilst Montefrio Ventures makes every effort to ensure that the description of the Property is accurate and that it meets the standards set out by Montefrio Ventures, they do not accept responsibility for any alterations made to the Property or its amenities since the Particulars were prepared.
Montefrio Ventures does not accept responsibility for any damage, loss, additional expense or inconvenience directly or indirectly caused by the failure of its plumbing, gas, electrical or other facilities or as a result of exceptional weather conditions within the property.
Montefrio Ventures does not accept any responsibility for the personal belongings of the Hirer or the Hirer's motor car and it is the responsibility of the Hirer to arrange appropriate insurance cover in respect of these items.
The Hirer shall be entitled to occupy the Property from 17.00 on the day of arrival and must vacate the Property before 10am on the day of departure unless there has been prior agreement to the contrary with Montefrio Ventures. Any variation must be clearly stated in the booking confirmation.
Cancellation insurance is not compulsory but Montefrio Ventures does strongly recommend such insurance cover to protect against cancellation penalties. Holiday insurance should be available through your own insurance brokers.
Montefrio Ventures shall be allowed the right of entry to the Property at all reasonable times for the purposes of inspection or to carry out any necessary repairs or maintenance.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded. The exclusions and limitations of liability in these Terms apply only to the extent permitted by law. These Terms do not affect your mandatory statutory rights as a consumer under Spanish law (in particular Royal Legislative Decree 1/2007, TRLGDCU) and EU law; any term that would be unfair to a consumer under that legislation shall not apply.
Because the accommodation is provided for specific dates, the 14-day right of withdrawal that normally applies to distance and off-premises contracts does not apply to your booking (Article 103(l) of Royal Legislative Decree 1/2007, TRLGDCU, implementing Article 16(l) of Directive 2011/83/EU). Cancellations are instead governed by clauses 3, 4 and 6 above.
The Property is registered in the Registro de Turismo de Andalucía as a vivienda turística de alojamiento rural under registration number VTAR/GR/01651 (4 bedrooms, maximum 8 guests).
Personal data provided in connection with an enquiry or booking is processed in accordance with Regulation (EU) 2016/679 (GDPR) and our Privacy Policy.
These Terms are governed by Spanish law. As a consumer, you also enjoy the mandatory consumer-protection rules of your country of residence, and, where EU rules so provide, you may bring proceedings in the courts of your own domicile. Complaints should first be addressed to us at cortijo.bujio1877@gmail.com (see clause 15); as a consumer you may also turn to the Spanish consumer arbitration system (Sistema Arbitral de Consumo) or the competent consumer authority.
